On June 28, 2010, the Ministry of Commerce issued announcement No. 40 of 2010, deciding to impose anti-dumping duties on imported carbon steel fasteners originating in the EU, with the tax rate ranging from 6.1% to 26.0%. On June 28, 2016, the Ministry of Commerce issued announcement No. 24 of 2016, deciding to continue to levy anti-dumping duties on imported carbon steel fasteners originating in the EU at the rate published in Announcement No. 40 of 2010 from June 29, 2016 for a period of five years. On September 19, 2017, the Ministry of Commerce issued announcement No. 50 of 2017, which adjusted the anti-dumping tax rate applicable to carbon steel fasteners imported from Royal nedschroff Holdings Co., Ltd. and its affiliates from 26.0% to 5.5%.
On January 29, 2021, the Ministry of Commerce issued announcement No. 3 of 2021. According to the announcement, after the end of the brexit transition period on December 31, 2020, the trade remedy measures previously implemented for the EU will continue to apply to the EU and the UK, and the implementation period will remain unchanged; After that date, the new trade remedy investigation and review cases launched by the EU will no longer deal with the UK as an EU member state.
On April 28, 2021, the Ministry of Commerce received the application for final review of anti-dumping measures submitted by fastener branch of China General Machinery Parts Industry Association on behalf of China's carbon steel fastener industry. The applicant claims that if the anti-dumping measures are terminated, the dumping of imported carbon steel fasteners originating in the EU and the UK may continue, and the damage caused to Chinese industry may continue. The applicant requests the Ministry of Commerce to conduct a final review investigation on the imported carbon steel fasteners originating in the EU and the UK, and maintain the anti-dumping measures against the imported carbon steel fasteners originating in the EU and the UK.
In accordance with the relevant provisions of the anti dumping regulations of the people's Republic of China, the Ministry of Commerce has examined the qualifications of the applicant, the relevant information of the investigated products and similar products in China, the import of the investigated products during the implementation of anti-dumping measures, the possibility of the continuation or recurrence of dumping, the possibility of the continuation or recurrence of injury and relevant evidence. The existing evidence shows that the applicant meets the provisions on industry and industry representation in Articles 11, 13 and 17 of the anti dumping regulations of the people's Republic of China, and is qualified to file an application on behalf of China's fastener industry. The investigating authority believes that the applicant's claims and the prima facie evidence submitted meet the requirements for filing a case for final review.
According to Article 48 of the anti dumping regulations of the people's Republic of China, the Ministry of Commerce decided to conduct a final review investigation on the anti-dumping measures applicable to imported carbon steel fasteners originating from the European Union and the United Kingdom from June 29, 2021. The relevant matters are hereby announced as follows:
1、 Continue to implement anti-dumping measures
According to the proposal of the Ministry of Commerce, the Tariff Commission of the State Council decided to continue to levy anti-dumping duties on imported carbon steel fasteners originating in the European Union and the United Kingdom in accordance with the scope and tax rate of taxable products published in Announcement No. 40 of 2010, Announcement No. 24 of 2016, announcement No. 50 of 2017 and Announcement No. 3 of 2021 of the Ministry of Commerce during the final review and investigation of anti-dumping measures.

2、 Review investigation period
The dumping investigation period of this review is from January 1, 2020 to December 31, 2020, and the industrial injury investigation period is from January 1, 2016 to December 31, 2020.
3、 Review and investigate product scope
The scope of reviewed products is the products to which the original anti-dumping measures are applicable, which is consistent with the product scope in Announcement No. 40 of the Ministry of Commerce in 2010, as follows:
Name of the investigated product: carbon steel fasteners (English Name: certain iron or steel fasteners), including wood screws, self tapping screws, screws and bolts (whether with nuts or washers, but excluding screws used to fix the rail and screws and bolts with rod diameter not exceeding 6mm) and washers. The investigated products do not include nuts and fasteners for civil aircraft maintenance and repair.
The product is now classified in the import and export tariff of the people's Republic of China 73181200, 73181400, 73181590, 73181510, 73182100 and 73182200.
4、 Review content
The content of this reexamination investigation is: if the anti-dumping measures against imported carbon steel fasteners originating from the EU and the UK are terminated, whether it may lead to the continuation or recurrence of dumping and injury.
5、 Register to participate in the survey
Interested parties may register with the trade remedy Investigation Bureau of the Ministry of Commerce to participate in the final review investigation of the anti-dumping period within 20 days from the date of promulgation of this announcement. The interested parties participating in the investigation shall provide the basic identity information, the quantity and amount of the investigated products exported or imported to China, the quantity and amount of similar products produced and sold, and the related information according to the reference form for registration to participate in the investigation《 The reference form for registration to participate in the investigation can be downloaded from the website of the Ministry of Commerce and the sub website of the trade remedy Investigation Bureau.
Interested parties shall register to participate in this anti-dumping investigation through the "information platform for trade remedy investigation"( http://etrb.mofcom.gov.cn )The electronic version shall be submitted, and the written version shall be submitted at the same time according to the requirements of the Ministry of Commerce. The contents of the electronic version and the written version shall be the same, and the format shall be consistent.
The interested parties mentioned in this announcement refer to the individuals and organizations specified in Article 19 of the anti dumping regulations of the people's Republic of China.
6、 Access to public information
Interested parties may find, read, copy and copy the non confidential text of the application submitted by the applicant in the website of the trade remedy Investigation Bureau of the Ministry of Commerce or in the trade remedy public information consulting room of the Ministry of Commerce (Tel: 0086-10-65197878). During the investigation, interested parties can find, read, copy and copy the public information of the case through relevant websites or the trade remedy public information reference room of the Ministry of Commerce.
7、 Comments on filing
If interested parties need to comment on the product scope and applicant qualification of this investigation, the investigated countries (regions) and other relevant issues, they can submit their written opinions to the trade remedy Investigation Bureau of the Ministry of Commerce within 20 days from the date of this announcement.
8、 Investigation method
According to Article 20 of the anti dumping regulations of the people's Republic of China, MOFCOM may obtain information from relevant interested parties and conduct investigations by means of questionnaires, sampling, hearings, on-site verification, etc.
In order to obtain the information required for the investigation of this case, the Ministry of Commerce usually issues a questionnaire to the interested parties within 10 working days from the deadline for registration and participation in the investigation specified in this announcement. Interested parties can download the questionnaire from the website of the Ministry of Commerce and the sub website of the trade remedy Investigation Bureau.
Interested parties shall submit complete and accurate answers within the specified time. The answer sheet shall include all the information required by the questionnaire.
9、 Submission and processing of information
Interested parties shall submit comments, answers, etc. during the investigation through the "information platform for trade remedy investigation"( http://etrb.mofcom.gov.cn )The electronic version shall be submitted, and the written version shall be submitted at the same time according to the requirements of the Ministry of Commerce. The contents of the electronic version and the written version shall be the same, and the format shall be consistent.
If the information submitted by the interested party to the Ministry of Commerce needs to be kept confidential, it may request the Ministry of Commerce to keep the relevant information confidential and explain the reasons. If MOFCOM agrees to its request, the interested party applying for confidentiality shall also provide the non confidential summary of the confidential information. The non confidential summary shall contain sufficient and meaningful information to enable other interested parties to have a reasonable understanding of the confidential information. If the non confidential summary cannot be provided, the reasons shall be explained. If the information submitted by interested parties does not specify the need for confidentiality, the Ministry of Commerce will treat the information as public information.
10、 Consequences of non cooperation
According to Article 21 of the anti dumping regulations of the people's Republic of China, when MOFCOM conducts an investigation, the interested parties shall truthfully reflect the situation and provide relevant materials. Where an interested party fails to truthfully report the situation or provide relevant materials, or fails to provide necessary information within a reasonable time, or seriously hinders the investigation in other ways, MOFCOM may make a ruling on the basis of the facts obtained and the best information available.
11、 Investigation period
The survey starts from June 29, 2021 and should be completed before June 28, 2022.
